Defense Verdict for Nursing Home Client in Medical Malpractice Case

Huie partners Gordon Sproule and Bart Cannon secured a defense verdict for a nursing home client in a medical malpractice case pending in the United States District Court for the Northern District of Georgia, Atlanta division.

The Challenge

Plaintiff sued our nursing home client in the state court of Dekalb County, Georgia claiming that the deceased nursing home resident was injured during her residency at the nursing home. The deceased was a long-term resident, and Plaintiff claimed that certain care she received fell below the standard of care causing her injuries. The deceased was hospitalized for several days, and Plaintiff’s counsel claimed that, had the standard of care been met by the nursing home, the deceased would not have had the extended hospitalization.

Our Approach

Huie approached this case head-on by first removing the case to the United States District Court for the Northern District of Georgia, Atlanta division. Huie then hired an expert and worked with the in-house dietician to show the jury that the care the deceased received met or exceeded the applicable standard of care. The Huie team also effectively cross-examined Plaintiff’s experts and utilized motions in limine to effectively preclude the jury from hearing prejudicial evidence.

Results

After a one-week trial, a defense verdict was secured for the nursing home.
