Huie, Fernambucq & Stewart attorneys, Megan Jones and Tom Bazemore, obtained summary judgment in Jefferson County, Alabama on behalf of Allstate Insurance Company in a case where the plaintiffs claimed Allstate breached the insurance contract and acted in bad faith in denying their claim. The plaintiffs argued that Allstate’s request that they sit for an examination under oath was unreasonable in light of the loss and sought compensatory damages for breach of contract and bad faith. Summary judgment was granted and the case was dismissed with prejudice after the court found that an examination under oath is part of the investigation process and an insurer has a right to seek all information regarding the insured’s claim before making an adequate determination of its obligations.
