Summary Judgment for an Automobile Manufacturer in Vehicle Warranty Case
Huie partner Bart Cannon and associates Meredith Maitrejean and Brian Donald recently obtained summary judgment related to all claims on behalf of an automobile manufacturer.
The lawsuit involved claims related to a van that Plaintiff previously had upfitted for use as an ambulance in its emergency medical services business. After presenting the vehicle to an authorized dealership for various transmission and engine related repairs, the plaintiff filed suit against the manufacturer asserting claims for breach of warranty and breach of contract. At the close of discovery, the manufacturer filed a Motion for Summary Judgment requesting the Court to dismiss all claims because the evidence proved that the repairs at issue were not covered under the applicable warranty. Once the Motion was fully briefed, the Court held a hearing where evidence from both sides was presented and considered by the Court. The Court subsequently granted the manufacturer’s Motion and dismissed all claims with prejudice.
