The case arose from the alleged theft of video game equipment from the defendant’s store. By the time the criminal case went to trial, the employees involved were no longer employed and did not testify resulting in dismissal of the shoplifting charges. Affidavits from the employees established that the employees had fully investigated the incident by reviewing security footage, checking records of who had an opportunity to steal the equipment and consulting with authorities on how to proceed. The court agreed that the investigation as described in the affidavits established probable cause, that the good-faith statements to law enforcement were privileged and dismissed all claims against the Defendant with prejudice.
