Huie, Fernambucq & Stewart attorneys Gordon Sproule and Charles Fleming obtained a defense verdict for a Mobile, Alabama nursing home in the Circuit Court of Mobile County, Alabama on December 13, 2013, after a five day jury trial. Plaintiff’s counsel requested $2 million in damages during the trial.
The personal injury action was brought by a resident of the nursing home for the development of four decubitus ulcers on his feet and heels. The plaintiff claimed that the ulcers occurred because the nursing home breached the standard of care by failing to properly assess his risk of developing pressure sores and by failing to implement appropriate interventions to guard against that risk. Defense counsel, Sproule and Fleming, proved that the interventions and treatment provided by the facility were appropriate and timely, and that the wounds were clinically unavoidable.
